Balochistan High Court dismisses petition of continuation of medical and dental education of Afghan nationals in Pakistan
A Bench comprising of Justice Muhammad Aamir Nawaz Rana and Justice Abdul Qayyum Lehri of the Balochistan High Court, while delivering its judgment, dismissed Constitutional Petition, concerning the continuation of medical and dental education and postgraduate training of Afghan nationals in Pakistan.
The Court held that foreign nationals do not have an indefeasible right to continue studies or undergo training in Pakistan contrary to the policy of the Government.
The Court observed that matters concerning immigration, repatriation of foreign nationals, national security and continuation of stay primarily fall within the executive domain.
The Court further held that Afghan nationals are entitled to humane treatment, dignity and due process under the law, but these protections do not create an unrestricted right to remain or continue education and training in Pakistan contrary to prevailing State policy.
However, the affectees were directed to approach the Afghan Embassy for redressal of their grievance.
The petition was accordingly dismissed in limine.
